Bioethics conjures images of dramatic healthcare challenges, yet everyday clinical ethics issues unfold regularly. Without sufficient ethical awareness and a relevant working skillset, clinicians can feel ill-equipped to respond to the ethical dimensions of everyday care. Bioethicists were interviewed to identify the essential skills associated with everyday clinical ethics and to identify educational case scenarios to illustrate everyday clinical ethics. Individual, semi-structured interviews were conducted with a convenience sample of bioethicists. Bioethicists were asked: (1) What are the essential skills required (...) for everyday clinical ethics? And (2) What are potential educational case scenarios to illustrate and teach everyday clinical ethics? Participant interviews were analyzed using qualitative content analysis. Twenty-five (25) bioethicists completed interviews (64% female; mean 14.76 years bioethics experience; 80% white). Five categories of general skills and three categories of ethics-specific skills essential for everyday clinical ethics were identified. General skills included: (1) Awareness of Core Values and Self-Reflective Capacity; (2) Perspective-Taking and Empathic Presence; (3) Communication and Relational Skills; (4) Cultural Humility and Respect; and (5) Organizational Understanding and Know-How. Ethics-specific skills included: (1) Ethical Awareness; (2) Ethical Knowledge and Literacy; and (3) Ethical Analysis and Interaction. Collectively, these skills comprise a Toolbox of Everyday Clinical Ethics Skills. Educational case scenarios were identified to promote everyday ethics. Bioethicists identified skills essential to everyday clinical ethics. Educational case scenarios were identified for the purpose of promoting proficiency in this domain. Future research could explore the impact of integrating educational case scenarios on clinicians’ ethical competencies. (shrink)

In this paper I do two things: (1) I support the claim that there is still some confusion about just what the Quine-Putnam indispensability argument is and the way it employs Quinean meta-ontology and (2) I try to dispel some of this confusion by presenting the argument in a way which reveals its important meta-ontological features, and include these features explicitly as premises. As a means to these ends, I compare Peter van Inwagen’s argument for the existence of properties with (...) Putnam’s presentation of the indispensability argument. Van Inwagen’s argument is a classic exercise in Quinean meta-ontology and yet he claims – despite his argument’s conspicuous similarities to the Quine-Putnam argument – that his own has a substantially different form. I argue, however, that there is no such difference between these two arguments even at a very high level of specificity; I show that there is a detailed generic indispensability argument that captures the single form of both. The arguments are identical in every way except for the kind of objects they argue for – an irrelevant difference for my purposes. Furthermore, Putnam’s and van Inwagen’s presentations make an assumption that is often mistakenly taken to be an important feature of the Quine-Putnam argument. Yet this assumption is only the implicit backdrop against which the argument is typically presented. This last point is brought into sharper relief by the fact that van Inwagen’s list of the four nominalistic responses to his argument is too short. His list is missing an important – and historically popular – fifth option. (shrink)

Aberrant consumer behaviour costs firms millions of pounds a year, and the Internet has provided young techno-literate consumers with a new medium to exploit businesses. This paper addresses Internet related ethics and describes the ways in which young consumers misdemean on the Internet and their attitudes towards these. Using a sample of 219 generation Y consumers, the study identified 24 aberrant behaviours which grouped into five factors; illegal, questionable activities, hacking related, human Internet trade and downloading. Those perceived as least (...) wrong were; "Downloading movie and music files from the Internet for free". The consequences of these behaviours have implications for educators, consumer policy and marketers. (shrink)

Multilevel research strategies characterize contemporary molecular inquiry into biological systems. We outline conceptual, methodological, and explanatory dimensions of these multilevel strategies in microbial ecology, systems biology, protein research, and developmental biology. This review of emerging lines of inquiry in these fields suggests that multilevel research in molecular life sciences has significant implications for philosophical understandings of explanation, modeling, and representation.

A review of fraud in medical research in Britain, Europe, the USA and Australia. It includes a history of known cases of fraud since 1974 and discusses ways for detecting and dealing with fraud that have been devised by government agencies, pharmaceutical companies, academic institutions and scientific publications (especially medical journals).

Judicial Deliberations compares how and why the European Court of Justice, the French Cour de cassation and the US Supreme Court offer different approaches for generating judicial accountability and control, judicial debate and deliberation, and ultimately judicial legitimacy. Examining the judicial argumentation of the United States Supreme Court and of the French Cour de cassation, the book first reorders the traditional comparative understanding of the difference between French civil law and American common law judicial decision-making. It then uses this analysis (...) to offer the first detailed comparative examination of the interpretive practice of the European Court of Justice. Lasser demonstrates that the French judicial system rests on a particularly unified institutional and ideological framework founded on explicitly republican notions of meritocracy and managerial expertise. Law-making per se may be limited to the legislature; but significant judicial normative administration is entrusted to State selected, trained, and sanctioned elites who are policed internally through hierarchical institutional structures. The American judicial system, by contrast, deploys a more participatory and democratic approach that reflects a more populist vision. Shunning the unifying, controlling, and hierarchical French structures, the American judicial system instead generates its legitimacy primarily by argumentative means. American judges engage in extensive debates that subject them to public scrutiny and control. The ECJ hovers delicately between the institutional/argumentative and republican/democratic extremes. On the one hand, the ECJ reproduces the hierarchical French discursive structure on which it was originally patterned. On the other, it transposes this structure into a transnational context of fractured political and legal assumptions. This drives the ECJ towards generating legitimacy by adopting a somewhat more transparent argumentative approach. (shrink)

Video ethics in educational research involving children is a recent topic that has arisen since the increase in the use of visual mediums in research especially with the development of new and ubiquitous internet technologies and social media. This paper emerged as an expressed concerned by a group of scholars associated with the new Video Journal of Education and Pedagogy that was established in 2016. The paper is the result of a collective writing process over a period of a few (...) months that discusses visual studies in education and visual ethics in relation to qualitative research in education, and as it applies to children. Over two hundred years ago, Thomas Jefferson suggested the need for a broader legal curriculum. As the twenty-first century begins, the practice of law will increasingly demand interdisciplinary knowledge and collaboration — between those trained in law and a broad range of scientific and technical fields, including engineering, biology, genetics, ethics, and the social sciences. The practice of public health law provides a model for both the substantive integration of law with science, and for the way its practitioners work. People with lived experience are individuals who have first-hand experience of the medical condition being considered. The value of including the viewpoints of people with lived experience in health policy, health care, and health care and systems research has been recognized at many levels, including by funding agencies. However, there is little guidance or established best practices on how to include non-academic reviewers in the grant review process. Here we describe our approach to the inclusion of people with lived experience (...) in every stage of the grant review process. After a budget was created for a specific call, a steering committee was created. This group included researchers, people with lived experience, and health systems administrators. This group developed and issued the call. After receiving proposals, stage one was scientific review by researchers. Grants were ranked by this score and a short list then reviewed by people with lived experience as stage two. Finally, for stage three, the Steering Committee convened and achieved consensus based on information drawn from stages one and two. Our approach to engage people with lived experience in the grant review process was positively reviewed by everyone involved, as it allowed for patient perspectives to be truly integrated. However, it does lengthen the review process. The proposed model offers further practical insight into including people with lived experience in the review process. (shrink)

Many philosophical naturalists eschew analysis in favor of discovering metaphysical truths from the a posteriori, contending that analysis does not lead to philosophical insight. A countercurrent to this approach seeks to reconcile a certain account of conceptual analysis with philosophical naturalism; prominent and influential proponents of this methodology include the late David Lewis, Frank Jackson, Michael Smith, Philip Pettit, and David Armstrong. Naturalistic analysis is a tool for locating in the scientifically given world objects and properties we quantify over in (...) everyday discourse. This collection gathers work from a range of prominent philosophers who are working within this tradition, offering important new work as well as critical evaluations of the methodology. Its centerpiece is an important posthumous paper by David Lewis, "Ramseyan Humility," published here for the first time. The contributors first address issues of philosophy of mind, semantics, and the new methodology's a priori character, then turn to matters of metaphysics, and finally consider problems regarding normativity. The earlier volume in this series dealt with two religions of Indian origin, namely, Buddhism and Jainism. The Indian religious scene, however, is characterized by not only religions which originated in India but also by religions which entered India from outside India and made their home here. Thus religious life in India has been enlivened throughout its history by the presence of religions of foreign origin on its soil almost from the very time they came into existence. This volume covers (...) three such religions—Zoraoastrianism, Judaism, and Islam. In the case of Zoraostianism, even its very beginnings are intertwined with India, as Zoroastrianism reformed a preexisting religion which had strong links to the Vedic heritage of India. This relationship took on a new dimension when a Zoroastrian community, fearing persecution in Persia after its Arab conquest, sought shelter in western India and ultimately went on to produce India’s pioneering nationalist in the figure of Dadabhai Naoroji ( 1825-1917), also known as the Grand Old Man of India. Jews found refuge in south India after the destruction of the Temple by the Romans in 70 C.E. and have remained a part of the Indian religious scene since then, some even returning to Israel after it was founded in 1948. Islam arrived in Kerala as soon as it was founded and one of the earliest mosques in the history of Islam is found in India. Islam differs from the previously mentioned religions inasmuch as it went on to gain political hegemony over parts of the country for considerable periods of time, which meant that its impact on the religious life of the subcontinent has been greater compared to the other religions. It has also meant that Islam has existed in a religiously plural environment in India for a longer period than elsewhere in the world so that not only has Islam left a mark on India, India has also left its mark on it. Indeed all the three religions covered in this volume share this dual feature, that they have profoundly influenced Indian religious life and have also in turn been profoundly influenced by their presence in India. This book introduces Robert Corrington’s “ecstatic naturalism,” a new perspective in understanding “sacred” nature and naturalism, and explores what can be done with this philosophical thought. This is an excellent resource for scholars of Continental philosophy, philosophy of religion, and American pragmatism.

Arthur O. Lovejoy famously referred to thirteen pragmatisms. If he were called on to enumerate postmodernisms, no doubt he would increase this number tenfold.1 Fortunately I need not follow his lead for the task at hand, namely, to discuss whether the pragmatic tradition can narrow the divide between modernism and postmodernism on the topic of cosmopolitanism. To do so I will focus on specific sets of ideas that have been associated with these terms. So, for example, modernists have been viewed (...) as defenders of some form of universality, ethical or conceptual, and of a responsible, self-actuating, authentic subject. Postmodernists look toward particularity and alterity, and stress that notions of a unitary subject .. (shrink)

John Cassian, an Egyptian monk in the early fifth century offers splendid wisdom and counsel regarding many spiritual disciplines. This reflection describes a personal experience of journeying with Cassian's prayer. In the most frequently quoted excerpt from his Conferences, Cassian raises up a prayer formula using Psalm 70:1 as a verse to facilitate unceasing prayer of the heart: “O God, come to my assistance; Lord, make haste to help me. “ In an unexpected and surprising way, this verse from Psalm (...) 70 comes to appear in the Liturgy of the Hours, as a preamble verse to Morning, Daytime, and Evening Prayer. Over the centuries, this simple verse from the Psalms has carried an entire prayer tradition, rooted in the spirituality of the desert. Cassian's elucidation of this verse reminds us how a formative reading of Scripture is integrally bound to the soul's progress in prayer. (shrink)

Los teóricos estadounidenses conocidos como “los nuevos originalistas” han propuesto en los años recientes una visión de la adjudicación constitucional y de la implementación constitucional extra-judicial que concede un lugar central a la distinción entre “interpretación constitucional” y “construcción constitucional.” La primera es entendida como el proceso consistente en determinar el significado lingüístico del texto constitucional mientras que la construcción es el proceso consistente en traducir el significado lingüístico a tests o reglas jurídicas, paradigmáticamente, aunque de forma no exclusiva, para (...) hacer más preciso un texto vago. Este artículo, escrito en el contexto de un simposio sobre la distinción interpretación/construcción en la teoría constitucional, hace una evaluación crítica de la coherencia y utilidad de cincelar de este modo el espacio constitucional de implementación. Argumenta que suplementar la interpretación constitucional con la noción de construcción constitucional no salva al originalismo de los muchos cuestionamientos que enfrenta; que la distinción entre la determinación del significado lingüístico y la construcción de tests o reglas jurídicas no es particularmente útil; y que la distinción más clara en este ámbito es la que distingue entre la determinación del significado o contenido jurídico de un texto y la formulación de doctrina para implementar o administrar ese significado jurídico. Ésa es la distinción que fundamenta la distinción que yo y otros académicos hemos trazado con anterioridad entre “proposiciones constitucionales operativas” y “reglas constitucionales de decisión.”. The two-dimensional framework in semantics has the most power and plausibility when combined with a kind of global semantic neo-descriptivism. If neo-descriptivism can be defended on the toughest terrain - the semantics of ordinary proper names - then the other skirmishes should be easier. This paper defends neo-descriptivism against two important objections: that the descriptions may be inaccessibly locked up in sub-personal modules, and thus not accessible a priori, and that in any case all such modules bottom out in purely (...) causal mechanisms, and that thus an externalist causal metasemantic theory will best account for them. I agree both that many descriptions are in some sense modularized, and that they bottom out in causal mechanisms. But I argue that these are not the relevant descriptions that two-dimensionalism trades in, and which make us, in an important sense, masters of our meanings. (shrink)

In spite of his cape and lamé tights, he is no fi ction; he’s a real person. By contrast, Pegasus, Zeus and the like are fi ctions. None of them is real. In fact, not only is each of them different from the others, all (...) differ from Angle Grinder Man. After all, Zeus throws thunderbolts but doesn’t remove boots from cars; unlike Superman, Angle Grinder Man couldn’t leap over a parked Mini, and all sightings suggest that he is a human being, not a horse. Faith and Criticism addresses a central problem in the church today--the tension between traditionalists and progressives. Traditionalists want above all to hold fast to traditional foundations in belief and ensure that nothing of value is lost, even at the risk of a clash with "modern knowledge." Progressives are concerned above all to proclaim a faith that is credible today, even at the risk of sacrificing some elements of traditional doctrine. They are often locked in uncomprehending conflict. Basil Mitchell argues (...) that, not only in theology but in any other serious intellectual pursuit, faith and criticism are interdependent. A tradition which is not open to criticism will eventually ossify; and without faith in some established tradition criticism has nothing to fasten upon. This interdependence of faith and criticism has implications for society at large. Religious education can be Christian without ceasing to be critical, and a liberal society can espouse Christian values. (shrink)

Este escrito se propone exponer, desarrollar y fundamentar, a grandes rasgos, un cuestionamiento interpretativo sobre la vinculación entre J. Rancière y L. Althusser, específicamente en torno a la concepción de policía del primero y de aparato de Estado del segundo. Es conocido que, en una primera etapa, Rancière fue cercano al pensamiento de Althusser, pero nunca un adherente del mismo. No obstante, en su pensamiento político se pueden hallar residuos y vestigios que parecieran dar cuenta de aquella primera relación intelectual (...) que se trazó como un cruzamiento entre ambos autores. Teniendo esto en mente, se vuelve menos descabellado el plantear lo siguiente como eje de este texto: que la caracterización de lo policiaco o de la policía, tal como está en algunos textos de Rancière, tiende a insinuar un cierto símil con la noción de aparato de Estado, propia del marxismo althusseriano, en tanto que se considera a este último en su duplicidad o doble faceta: aparato represivo de Estado y aparatos ideológicos de Estado. ¿Es plausible una lectura interpretativa que se maneje en esta clave, siguiendo esta intuición pese a todas las objeciones que se alzan a la brevedad? Nucleation and motion of kink pairs on partial dislocations are examined by elasticity theory for materials with a high Peierls stress. Two approaches are used: one considers the change in average stacking-fault energy due to alloying elements and the other considers the change in local SFE due to a nearby solute atom. Both approaches highlight the role of SFE on kink nucleation, propagation and annihilation and both furnish strain rate as a function of stress, temperature and SFE. Model predictions are (...) compared with yield stress data for two systems: firstly, an intermetallic, MoSi 2 , which softens for alloying elements that decrease the SFE and hardens for Re additions that increase the SFE; secondly, a ceramic oxide, MgO-Al 2 O 3 spinel, which softens with increasing addition of excess alumina and at the same time exhibits a decrease in SFE. The average SFE approach agrees qualitatively with the data while quantitative agreement is obtained with the local SFE approach. The possibility is considered that the model applies to other materials, such as TiAl, HfV 2 and Fe 3 Al, which show softening with certain alloying additions. One requirement is that the dislocations are dissociated more than a few atomic distances; otherwise kink nucleation occurs on the perfect dislocation . Hence the model does not apply to materials such as bcc metals which only have a core dissociation. Normal hardening effects of solutes from size and modulus misfits are additive with any softening effects from a decrease in SFE and so may mask the latter, as occurs for W additions to MoSi 2. We show that if there is an inner model with infinitely many measurable cardinals then there is a model (...) in which $\{J_\alpha [\mathscr{U}]: \alpha is not definable by any Σ 3 formula, and K ∩ H ω 1 is not definable by any boolean combination of Σ 3 formulas. Unlike the forcing used by Gitik. the iterated forcing $R_{\lambda +1}$ used in this paper has the property that if λ is a cardinal less then κ then $R_{\lambda + 1}$ can (...) be factored in V as $R_{\kappa + 1} = R_{\lambda + 1} \times R_{\lambda + 1, \kappa}$ where $\mid R_{\lambda +1}\mid \leq \lambda^+$ and $R_{\lambda + 1, \kappa}$ does not add any new subsets of λ.
